Erik Menendez has recently returned to prison after a brief hospital stay in a California medical facility for the treatment of kidney stones.
On a social media post dated Saturday, August 2, Erik’s stepdaughter Talia announced that the 54-year-old was out of the hospital post-surgery, according to information from TMZ.
“My dad is back in prison and getting ready for our upcoming parole hearing,” Talia, whose mother Tammi Saccoman is married to Erik, wrote on her Instagram.
Earlier reports by ABC News indicated that Erik was moved from the Richard J. Donovan Correctional Facility in San Diego to a nearby hospital to address a health issue. Talia later disclosed via social media that he was dealing with “serious complications from multiple large stones in both kidneys.”
TMZ was informed by Erik and Lyle Menendez’s attorney, Mark Geragos, on July 22 that Erik’s hospital stay lasted about a week due to a “serious medical condition.”
Following the news of his health condition, Geragos stated that Erik should be immediately released from prison.
“Due to medical privacy laws, we are restricted from providing more details,” stated the California Department of Corrections and Rehabilitation in an email to PEOPLE at that time.
The health issue arose roughly a month before a parole board hearing scheduled for Erik and his brother Lyle, now 57, set for August 21 and August 22. The brothers were famously convicted for the 1989 murder of their parents.
On May 13, the brothers were resentenced which made them eligible for parole, their sentences adjusted to 50 years to life.
On August 20, 1989, Erik, then 18, and Lyle, then 21, murdered their parents, José and Kitty Menendez, while they were in the TV room of their $5 million Beverly Hills mansion.
The brothers claimed they were driven to murder after enduring years of sexual abuse by their father, the chief operating officer of RCA Records, and neglect by their mother, a former beauty queen. They maintained that they acted out of fear for their lives after José allegedly threatened to kill them if the abuse was disclosed.
However, prosecutors argued that the motive was purely financial, pointing to the brothers’ extravagant spending following the murders.

“The Governor’s directive for a Comprehensive Risk Assessment for both Erik and Lyle Menendez reflects his intent to gather necessary information for a fair decision on their potential release after 35 years of imprisonment,” the lawyers stated.
The Menendez brothers took full responsibility for the murders during a virtual appearance at their May hearing, as reported by Fox News.
