A disturbing discovery was made by a Manhattan woman who claims to have found a piece of human finger in a chicken wrap she bought from a Mediterranean restaurant in Queens, known as Create Astoria. This incident, according to a lawsuit filed in the New York County Supreme Court on August 7, happened on November 17, 2023. The restaurant has since responded, calling the allegation “impossible” and “ludicrous.”
According to the legal documents, Smith was shocked to find “human tissue, specifically a fingertip,” while eating the wrap. Her attorney, Robert Menna, emphasized the severe psychological impact and physical disgust experienced by Smith due to this incident.
The lawsuit accuses the restaurant of negligence, claiming it caused Smith to endure considerable pain, shock, and mental suffering.
Her lawyer further explained that Smith bit into the wrap and encountered the fingertip, which fortunately, she did not swallow, but the experience left her traumatized.
It was revealed by Menna that the fingertip was sent to a laboratory for analysis where it was confirmed to be from a human female. However, the restaurant countered this claim by stating that no female employees were present on the day of the incident. Moreover, they mentioned that their insurance provider, Liberty Mutual, has denied Smith’s claims. PEOPLE magazine reached out to Liberty Mutual for a comment, which was not immediately available.
Menna has expressed his intention to pursue the case in court.

Another case involved Chopt Restaurant being sued after a woman allegedly found a human finger in her salad. Similarly, a shocking report from Burger King detailed a customer finding blood in her meal after an employee injured their finger.
Create’s owner, Teddy Karagiannis, has vehemently denied the allegations, labeling the lawsuit as “completely fraudulent” and indicating plans to sue Smith for slander. He stressed that the restaurant’s stringent food inspection processes should prevent such incidents. He described the claim as “ludicrous,” emphasizing the impossibility of such negligence in his establishment.
Karagiannis also suggested that Smith has refused DNA testing on the fingertip, which he believes would demonstrate that the finger does not belong to any of his staff. He speculated that the fingertip could have been sourced elsewhere by Smith.
Smith has spoken to the New York Post, revealing she was “permanently traumatized” by the ordeal, which also necessitated her undergoing intensive antiretroviral therapy to prevent potential infections from the human tissue.
